West End POS
Terms of service
Effective September 27, 2026
These terms are between West End Systems ("we", "us") and the business that signs up for West End POS ("you"). By starting a trial or using the service, the person accepting agrees for the business and confirms they're allowed to.
1. The service
West End POS is point-of-sale software for jewelry stores: the register, the back office, and the features in them (inventory, sales, repairs and orders, layaways, buying, customers, marketing, reports and more). We host it and keep it running. We'll keep improving it; if we take away something you rely on, we'll tell you ahead of time.
2. Your account and your people
You choose who gets access and what each person can do. Keep passwords and PINs private, remove people who leave, and tell us right away if you think someone got in who shouldn't have. You're responsible for what happens in your account under the access you give.
3. Trial, prices and billing
- Free trial: 30 days, no card needed. If no card is added by the end, the trial pauses; you have 14 days to add one before the back office turns read-only.
- Price: $249 a month per store, with 2 registers included, and $49 a month for each extra register, plus sales tax where it applies. Billing is monthly in advance through Stripe. Adding or removing a store or register changes the next bill, prorated for the rest of the month.
- Texting (optional): billed at what it costs us plus 25%, as shown when you turn it on.
- Price changes: we'll email you at least 30 days before a price change takes effect.
- Late payment: if a payment fails, you have 14 days to fix it. After that, the back office is read-only until billing is fixed. Registers keep selling, and signing in and the Billing page keep working.
- No refunds for partial months, except where the law requires them.
4. Cancelling
It's month to month. Tell us (support@westendsystems.com or Help in the back office) and we'll close the account: nothing more is charged, and the back office becomes read-only. You can download your data before or after you close.
5. Your data
Your business's data (inventory, sales, customers and the rest) belongs to you. You let us store and process it only to run the service for you, to support you, and to keep it secure. You can download everything as spreadsheets at any time. After you close, we keep your data so you can come back; ask us in writing to delete it and we will within 30 days, apart from what the law requires us to keep (like invoices). Backups age out within 30 days after that. Our privacy policy explains what we collect and who helps us run the service.
6. Your customers and your messages
You're responsible for having the right to keep your customers' information and to contact them. For email and texts:
- Send marketing only to people who said yes, and honor unsubscribes and STOP replies. The service records consent, adds unsubscribe links and handles STOP, but you're responsible for how you use it.
- Follow the laws that apply to you, including CAN-SPAM, the TCPA and the phone carriers' rules.
- The business details you give for texting registration must be true and yours.
7. Card payments
Card payments run through your own Square account, under Square's terms. We connect the register to it; we're not part of that agreement and don't control Square's fees, holds or payouts.
8. Jewelry-specific rules and taxes
The service helps with buying records, ID numbers, hold periods, sales tax and reports, but you're responsible for following the laws where you operate (for example local reporting rules for buying gold, and sales tax rates and filing). The service is a tool, not legal or tax advice.
9. What you may not do
Don't use the service for anything illegal, to send spam, to try to get into other businesses' data, to overload or attack it, to copy or resell it, or to take it apart to build a competing product.
10. Availability and support
We work to keep the service available, and registers keep selling without the internet. There may be short planned maintenance, and things outside our control can cause outages. We don't promise a specific uptime. Support is by Help in the back office and by email.
11. Suspension
We may suspend access for non-payment (as described above), for misuse that puts the service or others at risk, or where the law requires it. Except in an emergency, we'll tell you first and give you a chance to fix it.
12. Warranties and liability
The service is provided "as is." To the extent the law allows, we don't make promises beyond these terms. Neither of us is liable to the other for indirect or consequential losses (like lost profits). Our total liability for any claim is limited to what you paid us in the 12 months before it.
13. Changes to these terms
If we change these terms in a way that matters, we'll email the account owner at least 30 days before the change takes effect. Using the service after that means you accept the new terms.
14. The law that applies
These terms are governed by the laws of Kentucky, and any dispute goes to the state or federal courts in Kentucky.
